NBA Ice Bucket Game Official Rules.
Void Where Prohibited.
This Game may be modified, canceled or postponed by Sponsor at any time in its sole discretion due to pandemic (e.g., Coronavirus/COVID-19).
Eligibility: The NBA Ice Bucket Game(“Game”) is open to legal residents of the 50 United States and the District of Columbia, who are thirteen (13) years of age or older as of the date of participation (“Participants”), and who are in the Salt Lake City, UT area during the Game Period outlined below. Participants must have a parent’s or legal guardian’s permission to participate in this Game prior to participating. Employees, children of employees, officers, directors, representatives and agents of NBA Properties, Inc. (“Sponsor”), NBA Media Ventures, LLC, NBA Digital, the NBA and its member teams (the “NBA Entities”), and its member teams, and each of their respective parent companies, subsidiaries, affiliates, officers, governors, owners, distributors, retailers, advertising/promotion agencies (collectively, “Released Parties”), and the immediate family members (parent, spouse, sibling or child and their respective spouses, regardless of where they reside) and those living in the same household of each, whether or not related, are not eligible to participate or win a prize. Game is subject to all applicable federal, state, and local laws.
Game Period: The Game begins at 10:00:00AM Mountain Time(“MT”) on December 2, 2022 and 5:00:00PM ET on February 19, 2022 (“Game Period”). The Game will be divided into thirty four (34) entry periods (each an “Entry Period”) listed in the chart below (each entry period below may be referred to individually as an “Entry Period” and collectively, as the “Entry Periods”). Official time will be kept by Sponsor.
Game Important Note: By entering the Game, each Participant (or his/her parent or legal guardian) represents that he/she is in good physical condition and that he/she has the physical capacity to participate in the Game and understands and accepts all risks associated with participation in the Game. Each Participant also expressly acknowledges his/her understanding that the Game can be dangerous and can involve the risk of serious physical injury. Each Participant represents that he/she is participating in the Game voluntarily, with full knowledge of the potential risks entailed and he/she is expressly, knowingly and voluntarily assuming the risk of any and all physical injury associated with or caused by his participating in the Game.
How To Participate: During the Game Period visit Trolley Square, 602 E 500 S, Salt Lake City, UT, 84102, to participate in the Game as follows: a) i) If you are not already a registered user of the NBA Events App (the “App”), download the App on your iOS*or Android* device and follow the prompts to sign up (the download and signup are free); or ii) If you are already a registered user of the App, sign in as directed; b) Eligible Participants (in the case of a minor his/her parent or legal guardian) will be directed to register for the applicable Entry Period by completing the waiver form provided onsite; and c) Using the basketballs provided, each Participant will be given 0:30 seconds to successfully make as many basketball shots on any of the 5 designated hoops to earn the number of points outlined below.
Top Left Hoop: 4 points
Bottom Left Hoop: 2 points
Center Hoop: 3 points
Top Right Hoop: 4 points
Bottom Right Hoop: 2 points
If a participant makes a successful shot on each of the 5 hoops in less than 0:30 seconds, the game will continue and the participant will get an additional 0:30 seconds on the clock. The baskets rims will illuminate in the following order during the 0:30 seconds of game play:
1. Bottom-Left
2. Top-right
3. Bottom-right
4. Top-left
5. Center
If the participant make a successful shot on a rim that is illuminated, that shot will be worth double the points. For clarity, when the rims are illuminated and a successful shot is hit, they will earn the number of points outlined below:
Top Left Hoop: 8 points
Bottom Left Hoop: 4 points
Center Hoop: 6 points
Top Right Hoop: 8 points
Bottom Right Hoop: 4 points
All incomplete waiver forms will be void. In the event of a dispute as to the identity of an Participant, entry will be deemed submitted by the person named on the waiver form. Limit of one (1) entry per person using only one (1) App Registration/email will be accepted for each Entry Period. Additional entries received from the same person/email/App Registration in excess of the stated limitation will be void.
Participants’ are responsible for any charges of online service providers or wireless carriers. Completing an entry constitutes your consent to participate in the Game and consent for Sponsor to obtain, use, and transfer your name, address and other details for Game administration purposes. Except as noted in these Official Rules, information collected for this Game is used only for the purpose of Game administration and winner notification, and will not be re-used, sold or shared in any manner by the Released Parties or any third parties unless Participant is over 18 years of age and has elected to receive additional information from the Sponsor or any third party. By participating in the Game, participant agrees to all of the terms and conditions of the Sponsor’s Privacy Policy, which is available at www.nba.com/privacy-policy. In the event of any discrepancy between the Sponsor’s Privacy Policy and these Official Rules, these Official Rules shall control and govern.
Sponsor will not be responsible for late, lost, stolen, incomplete, misdirected, undelivered, delayed, garbled, damaged or inaccurate, emails, entry form submissions, or for telephonic, human or computer failures, problems or errors, interruptions in service due to system upgrades, repairs, modifications or other causes, failures or malfunctions of connections, satellite, network, cable, Internet Service Provider (ISP),phones, phone lines or telephone systems, traffic congestion on the internet, technical or mechanical malfunctions, jumbled, scrambled, delayed or misdirected transmissions, or network, typographical, printing, electronic, computer, mechanical or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise relating to or in connection with the Game, including, without limitation, (i) errors in connection with the administration of the Game, entry processing, the announcement of the prizes, the processing of entries, or in any other Game-related materials; (ii) interrupted or unavailable network, server, Internet Service Provider (ISP), cable, satellite or other connections; (iii) Internet traffic congestion or any technical problem, including, without limitation, any injury or damage to any person’s computer related to/resulting from Game participation; (iv) typographical, printing or other errors or omissions in these Official Rules, in any Game-related ads/materials; (v) human-processing error; (vi) electronic equipment, computer hardware or software failures; (vii) inaccurate entry information, whether caused by equipment, programming, human error, or otherwise; (viii) any condition caused by events that may cause the Game to be disrupted or corrupted; or (ix) any inability of the winners to accept a prize. Persons found tampering with or abusing any aspect of this Game or whose conduct potentially compromised the Game or who are in violation of these Official Rules as solely determined by the Administrator, will be disqualified. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Game. Persons who tamper with or abuse any aspect of the Game or Website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void.
Winner Determination: The Potential Prize winners will be determined following the conclusion of each respective Entry Period of the Game Period (as outlined above). The prizing will be divided into 3 categories, 1) Highest point total, 2) Performance, and 3) Participation.
HighestPoint Total Winner Determination: The Participant with the 1st highest point score for the applicable Entry Period (or tie-breaker, if applicable), will be declared the Grand Prize winner for that Entry Period. Participants with the 2nd highest point score at the end of the applicable Entry Period (or tie-breaker, if applicable), will be declared the First Prize winner for that Entry Period. Participants with the 3rd highest point scores at the end of the applicable Entry Period (or tie-breaker, if applicable), will be declared the Second Prize winner for that Entry Period. In the event of a tie, a tie-breaker will be conducted as outlined below.
Tie Breaker Details: In the event of a tie for any Prize level, the designated prize will be awarded to the tied Participant who earned the highest score in question at the earliest point in the day and subject to their compliance with these Official Rules.
Performance Winner Determination: Eligible Participants who score all five baskets will be awarded the Performance Prize outlined below. Up to 500 Prizes will be available per Entry Period.
Participation Offer: Eligible Participants who participate in the Game in accordance with these Official Rules will receive 5 NBA Reward Points which be emailed to each eligible participant.
The tabulation of Game Points and identification of potential winners will be conducted by Sponsor whose decisions are final and binding with respect to these Official Rules and in all other matters relating to this Game, including tabulation of Game Points for each Entry Period.
Winner Notification: Potential winners will be notified via the App as necessary throughout the Game Period with the final winner being notified no later than February 19, 2022. If a winner is a minor, applicable prize will be awarded in the name of his/her parent or legal guardian who will be responsible for complying with all requirements imposed on winners set forth herein. Potential Prize winner(s) may, be required to execute and return a Prize Claim and W9 tax form (for prizes with a value of $600 and over) in the timeframe designated by Sponsor. In the event of any failure to return such documents within the specified time period, if any prize notification or prize is returned as undeliverable, if Sponsor is unable to contact a potential winner, or noncompliance with these Official Rules, such winner will be disqualified and, in Sponsor’s discretion, the runner-up or an alternate for the prize at issue may be notified as the potential winner. Limit one (1) Prize per person/valid email address for the duration of the Game Period.
Prizes: Highest Score Prizes: One (1) awarded per Prize Level and Per Entry Period.
Performance Prizes: Up to (17,000) Entry Periods 1-33 Performance Prizes/up to (500) Performance Prizes awarded per Entry Period: Two (2) NBA Crossover Day Passes (ARV=$80).
Up to (500) Entry Period 34 Performance Prizes: One (1) $25 NBAstore.com digital gift code.
Participation Offer: Participation Offer/One (1) per Participant per Entry Period: (5) NBA Reward Points.
Total ARV of all prizes: $1,350,870. TRANSPORTATION TO/FROM GAME/EVENT AND LODGING ANDARE NOT INCLUDED AND ARE THE SOLE RESPONSIBILITY OF THE PRIZE WINNER. Tickets are subject to terms and conditions specified thereon. If any game is canceled, postponed, or not available for any reason, Sponsor will substitute prize with a prize of comparable or greater value. Winner and his/her applicable guest must comply with arena/event rules and regulations. Failure to do so may result in forfeiture of applicable game/event tickets. Game/Event tickets are subject to certain terms and conditions specified thereon. Seat locations at the applicable game/event shall be determined in the sole and absolute discretion of Sponsor, as applicable. All costs and expenses associated with the acceptance and use of any prize not specified herein as being awarded, including, but not limited to, all federal, state and local taxes are each winner’s sole responsibility. Gift Codes are subject to issuers restrictions.
Miscellaneous: No transfer, assignment, cash redemption, or substitution of prizes (or portion thereof) except by Sponsor, who reserves the right to substitute a prize (or applicable portion thereof) with one of comparable or greater value (except as otherwise provided above), at its sole discretion. Prizes are awarded “as is ”with no warranty or guarantee, either express or implied by Sponsor. All federal, state, and local taxes (including income and withholding taxes, if any) and all other costs and expenses associated with acceptance and use of a prize not specified herein as being awarded are winners’ sole responsibility. Sponsor, in its sole discretion, reserves the right to: 1.) disqualify any person who tampers with the entry process, or any other component of this Game, or who is otherwise in violation of these Official Rules; and 2.) modify, suspend or terminate this Game for any reason, as determined by Sponsor in its sole discretion including should unauthorized intervention or other causes, including but not limited to war, strikes, terrorist activities, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Game and, in the event of termination, at its discretion, select winners from among eligible, non-suspect entries received as of the date of the event requiring such termination. By participating, participants agree to be bound by these Official Rules and agree that: 1.) Released Parties and their designees and assigns may use (unless prohibited by law) such Participant’s name, voice, city/state of residence, biographical information, photograph, and/or other visual likeness for advertising and/or trade purposes and/or for TV or radio broadcasts and/or for any other purpose in any media or format now or hereafter known worldwide in perpetuity without further compensation, permission or notification; and 2.) Released Parties are released, will have no liability whatsoever for, and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind (whether due to negligence or otherwise) to person(s),including death, or property, resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, or participation in this Game.
ARBITRATION: Except where prohibited by law, as a condition of participating in this Program, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Programs, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held in New York County, New York; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Program), and participant further waives all rights to have damages multiplied or increased.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Program, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA.
